1. About these terms

These terms of service ("Terms") apply to your access to and use of biobuds.co.uk (the "Site"). The Site is run by LL Ventures Ltd, trading as BioBuds ("BioBuds", "we", "us"), a company registered in England and Wales (company number 16485979) with its registered office at 66 Kerridge Court, London, N1 4AL.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. If any part of these Terms is unclear, email us at hello@biobuds.co.uk.

2. Changes to these Terms

We may change these Terms from time to time, for example when we change the Site or the law changes. When we do, we will update the date at the top of this page. The changes take effect when we post them. If you keep using the Site after that, you accept the updated Terms, so please check this page from time to time.

3. Privacy

For information about how we collect and use personal data, please read our privacy policy.

4. Our product is in development

BioBuds is developing bio-based, biodegradable disposable earplugs, and the product is not yet on sale. Please bear the following in mind:

  • Renderings and visuals on the Site are illustrative and do not show the final manufactured product.
  • All specifications, performance, certification, end-of-life and environmental claims are preliminary and may change without notice.
  • Nothing on the Site is an offer to sell, and no contract for the supply of products is formed through the Site. Any future supply will be under a separate written agreement.
  • Nothing on the Site is safety advice. Choose hearing protection based on your own risk assessment and on products that are certified for your use.

5. Using the Site

You may use the Site to learn about BioBuds and to contact us. You agree not to:

  • use the Site in any way that is unlawful or fraudulent, or that breaches these Terms
  • send us content that is defamatory, infringes anyone's rights, or contains other people's personal information without their permission
  • send spam, or knowingly send viruses or other harmful code
  • try to gain unauthorised access to the Site, or to the systems it runs on, or get around its security or spam protection
  • interfere with, damage or overload the Site
  • use robots, scrapers or similar tools to copy or extract content from the Site
  • pretend to be someone else, or misrepresent your connection with a company or organisation

6. Enquiries and feedback you send us

When you contact us through the Site, please make sure the information you give is accurate and that you are allowed to share it. Please do not send us confidential information through the Site: unless we have agreed otherwise in writing, we will not treat what you send as confidential.

If you send us feedback, ideas or suggestions about BioBuds or the Site, we may use them freely, without any obligation or payment to you.

7. Our content and trade marks

The Site and its content, including text, designs, graphics, images and the BioBuds name and logo, are owned by us or our licensors and are protected by copyright, trade mark and other intellectual property laws. BioBuds is a registered trade mark of LL Ventures Ltd in the United Kingdom.

You may view the Site, and print or download extracts for your own reference or for internal use within your organisation. You may not otherwise copy, modify, republish or distribute any part of the Site, use it to build a competing product, or use our name or logo, without our written permission.

8. Links to and from other sites

The Site may link to websites and services run by other people. We do not control them and are not responsible for their content or how they handle your data. Their own terms and privacy policies apply when you use them.

You may link to the Site's home page, as long as you do so fairly and lawfully and do not suggest any association with or endorsement from us that does not exist. You may not frame the Site on another website.

9. Availability of the Site

The Site is free to use. We may change, suspend or withdraw all or part of it at any time without notice. We do not guarantee that the Site will always be available, uninterrupted or free from errors or viruses.

10. Our responsibility to you

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that:

  • The Site and its content are provided "as is", for general information only. We make no promises, express or implied, that the content is accurate, complete or up to date, and you should not rely on it.
  • We are not liable for any loss or damage arising from your use of, or inability to use, the Site, or from relying on its content, whether in contract, tort (including negligence), breach of statutory duty or otherwise.
  • In particular, we are not liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss.
  • If we are found liable to you despite the above, our total liability is limited to £100.

11. Ending your access

If you break these Terms, we may suspend or block your access to the Site.

12. General

  • These Terms are the entire agreement between you and us about your use of the Site, and replace any earlier agreement about it.
  • If a court decides that part of these Terms is invalid, the rest stays in effect.
  • If we do not enforce a right under these Terms straight away, we can still enforce it later.
  • No one other than you and us has any right to enforce these Terms.

13. Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about them or the Site. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
